The Implications of Selling Narcotics in California

Under the California Health and Safety Code 11352 HS, it is illegal for an individual to sell illicit and prescription controlled substances including cocaine, heroin, PCP, GHB, hydrocodone, morphine and codeine. It also states that, "Any individual who possesses for sale, purchase for the intention of sale, transports, imports, furnishes, administers, or distributes a controlled substance which is an unlawful narcotic is guilty of commition a felony crime and can be punished by imprisonment ranging from two to nine years." In the state of California, possessing a controlled substance, with the exception of marijuana, is a felony offense.

Selling Drugs

  • That you did in fact engaged in one of the acts specified above.

  • That there was enough of the drug as that it could have been used and that you had some sort of control over the drug. The drugs don't have to be in your grasp at that very moment, even if you had someone else sell the drugs for you that would be sufficient for a conviction.
