Embezzlement applies to people who violate their duty to protect or manage funds or property by a person or company. It falls under the category of
white collar crime as it usually takes place in a business or professional setting. Acts of embezzlement are committed with the intention of achieving personal financial gain at the expense of another or others.
A Recent Embezzlement Case
In New York, 54 year old Kathleen Heller was sentenced to prison for embezzling over $350,000 from Western New York Pediatrics while holding the position of chief financial officer. It was discovered that she had been manipulating payroll accounts as well as making unauthorized credit card charges for her personal benefit. It was also alleged that she misappropriated over $33,000 from the New York State Tax Department. Heller blamed her addiction to pain killers as the cause for her actions and apologized at her sentencing stating that she was wholeheartedly sorry.
Penalties for Embezzlement
Depending on the circumstances of the crime, a person can be tried for embezzlement in either the state or federal court system. Penalties often include time in jail or prison, monetary fines, restitution to the victims, community service, and more. If a person is convicted of a felony, it can affect many areas of his/her life including the ability to obtain employment in the future and training through educational systems. The ability to get loans and housing can also be affected. In essence, an embezzlement conviction can ruin one's reputation.
