Nevada has strict laws for DUI and if you are arrested, you are placing yourself at risk. You may lose your driver's license, be put in jail and may have monetary fines to pay as well. Having a DUI conviction on your record can affect your future in ways you may not even anticipate.
Penalties for DUI
First conviction: If this is your first conviction, you could be placed in jail for a minimum of 2 days and up to six months as well as be fined between $ 400-$1,000. You may be ordered to serve 96 hours of community service instead of jail; this would be something a DUI defense attorney could possibly help arrange in order for you to keep your freedom. Part of the justice process involves your driver's license being suspended for 3 months and you will have seven days after your arrest to contact the DMV to arrange a hearing for this purpose. You may also be ordered to enroll in an alcohol treatment program if your Blood alcohol level (BAC) was found to be .08 or above.
Second conviction: If you are convicted again within a 7 year period the penalties become harsher. Your license will be suspended for 1 year and you will also be ordered to jail or residential confinement from 10 days to 6 months.
The monetary fine will be anywhere from $750-$1,000 and you will be sentenced to serve 100 to 200 hours of community service. Your vehicle registration can be suspended and you may also be placed under clinical supervision of a treatment facility for up to an entire year. For a third conviction, all of the above stated penalties increase further and you can wind up in prison for a period of 1-6 years.
